Terms & Conditions of Sale

These Terms & Conditions of Sale ("Terms") govern the purchase of products from John Forsyth Shirt Co. / Forsyth of Canada ("Forsyth", "we", "our", or "us"). By placing an order through our website or directly with Forsyth, you agree to these Terms.

1. Wholesale Sales

Forsyth sells exclusively to approved wholesale customers. All account applications are subject to review and approval. We reserve the right to approve or decline any account or order at our discretion.

There is no minimum order requirement unless otherwise communicated for a specific product or seasonal program.

2. Payment Terms

Payment terms are based on the arrangements approved for each customer account.

Approved credit accounts may be provided with Net 30 payment terms, meaning payment is due within thirty (30) days of the invoice date. Other accounts may be required to pay by credit card or another approved payment method.

Overdue balances may result in delayed shipments, suspension of credit privileges, or cancellation of pending orders.

3. Shipping

Shipping dates are estimates only and are not guaranteed.

Canadian Orders

Unless otherwise agreed in writing, Canadian orders are shipped FOB Toronto, Ontario via Purolator or the customer's provided courier account. Shipping charges from Toronto to the customer's delivery location are the responsibility of the customer.

U.S. Orders

Unless otherwise agreed in writing, U.S. orders are shipped FOB Buffalo, New York via UPS or the customer's provided courier account. Shipping charges from Buffalo to the customer's delivery location are the responsibility of the customer.

Forsyth covers applicable duties and import fees for shipments to customers in the United States.

For all shipments, risk of loss transfers to the customer once the shipment has been released to the carrier at the applicable FOB shipping point.

Customers are responsible for inspecting all shipments upon delivery and reporting any shortages, damages, or shipping discrepancies to both the carrier and Forsyth immediately.
